R (on the application of Sainsbury’s Supermarkets Ltd) v Hillingdon London Borough Council [2015] EWHC 2571 (Admin), [2015] All ER (D) 369 (Jul)

The claimant, Sainsbury’s, applied for judicial review of the defendant local authority’s decision to grant the first interested party permission for the development of a food store. The Administrative Court, in dismissing the application, held that the impact and the sequential tests in the National Planning Policy Framework had been passed, and the reasons for the different conclusion in a prior application for a larger food store had been clear.
