As AI-generated ‘deepfake’ images proliferate, the law may already have the tools to respond. In NLJ this week, Jon Belcher of Excello Law argues that such images amount to personal data processing under UK GDPR

AI platforms, he says, are controllers determining the ‘purpose and means’ of processing.

Regulators’ response has been ‘pedestrian to say the least’, despite powers to levy fines of up to 4% of worldwide turnover. With new criminal offences on ‘purported intimate images’ emerging, enforcement, not legislation, is the missing ingredient, he writes.
